Oltens Terms and Conditions

Oltens to sklep internetowy, dostępny w domenie oltens.com (zwany dalej „Oltens”), prowadzony jest przez Oltens Sp. z o.o z siedzibą w Jarocinie (63-200) przy ul. Karola Marcinkowskiego 16, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy Poznań Nowe Miasto i Wilda, Wydział VIII Gospodarczy pod numerem KRS 0000676077. NIP: 7822705641, Regon: 367169832, z którą Klienci mogą się kontaktować pod następującym adresem mailowym: sklep@oltens.com, za pośrednictwem dostępnych na stronie oltens.com formularzy kontaktowych oraz telefonicznie pod numerem telefonu 61 224 70 00.

1. Oltens.com conducts online retail sales via the Internet. Orders are accepted by websites available on the oltens.com domain, via e-mail or telephone.
2. Customers have the possibility to use oltens.com, subject to point 4 below.
3. In order to use the shop's services, the customer should use an ICT system that meets the following criteria:
  • a computer or other electronic device to connect to the Internet,
  • a web browser that supports cookies,
  • e-mail address.
4. In the case of a legal person and an organisational unit without legal personality, all activities of this entity at oltens.com may be performed only by a person who is authorised to perform on behalf of this entity all activities related to the use of oltens.com and to exercise all rights and obligations of this entity as a Customer.
5. Entering into Agreements at oltens.com is possible, subject to the remaining provisions of the Terms and Conditions, upon fulfilment of the following conditions jointly:
  • correctly completing the electronic online form available on oltens.com website by providing the following data: name, surname, e-mail address, contact phone, delivery address.
  • acceptance of these Terms and Conditions.
  • reading and accepting the privacy policy or information obligation. Personal data of a customer making a purchase without registration will be processed pursuant to Article 6(1)(b) of the GDPR for a period no longer than that indicated in Article 70 § 1 of the Tax Ordinance.
6. All products available at oltens.com are brand new, free from physical and legal defects, with the exception of so-called outlet products, whose possible defects and damages are revealed in the product description. Notwithstanding the above, all products at oltens.com have been legally introduced to the Polish market.
7. All prices given on the oltens.com website are gross prices (including VAT). An invoice is issued for each item sold.
8. In the case of an order placed at oltens.com, the Customer makes a purchase by using the "I order and pay" button (for online payments) and "Confirm purchase" (for other forms of payment).
9. The customer is obliged to pay the price for the goods ordered at oltens.com, including delivery costs, no later than within 14 days from the date of purchase, subject to payment upon delivery.
10. The ordered goods are delivered by means of transport by specialised courier companies.
11. The Buyer shall bear the costs of the selected method of delivery specified in the Price List for Transport indicated at oltens.com under "Types of delivery", which depend on the size and weight of the ordered product and are visible for the Buyer in the shopping cart and calculated right before placing the order.
12. In a situation when there are big differences in the time of realisation or the way of packaging and delivery of individual products, which make up one order placed with oltens.com, Oltens Sp. z o.o. may decide to split the order into smaller shipments. In such a case, the total cost of delivery given to the Customer when placing an order may be subject to change, provided that this will take place only after prior contact with the Customer and their prior acceptance of the changes. In case of the Customer's non-acceptance referred to in the previous sentence, they may withdraw from the contract in whole or in part. In case of cancellation of a part of the order, the delivery costs that have been allocated to the undelivered or subject to complaint part of the order shall be corrected.
13. The following forms of payment are possible:
  • Upon delivery, cash payment to the courier. In selected cases oltens.com reserves the right to additional verification of such orders by phone.
  • By bank transfer - a form of payment for customers who prefer to log in to an online bank, visit a bank branch or post office. After placing an order, customer receives via e-mail the bank account number to which the appropriate amount should be transferred. Once the payment is credited to the bank account of Oltens Sp. z o.o., the order is transferred to the warehouse to complete and prepare the shipment.
  • Online transfer – a form of electronic payment serviced by PayU S.A. based in Poznań.
  • Payment Card (Visa, Mastercard) - each card payment transaction is securely authorised by PayU S.A. with its registered office in Poznań or Elavon  Financial Services Limited branch in Poland with its registered office in Warsaw (authorisation usually takes from a few to several minutes). As soon as the payment is confirmed, the order is handed over to the warehouse to prepare the completion and shipment.

14. In case of certain types of assortment available at oltens.com, Oltens Sp. z o.o. reserves the right to limit the method of payment by not providing certain payment options referred to in paragraph 13 above - relevant information in this respect shall be included in the product description.
15. Each product offered is accompanied by an approximate lead time. The products can be available on the spot (status "in stock") or on request (status "on request") - the Customer is informed about the availability of products on the product card. An order for products with different lead times is sent out after the completion of the whole. i.e. after the longest time specified for the ordered products. If an order is divided, individual parcels may be sent at different dates, of which the Customer is informed by e-mail. If the delivery time is longer than specified, Oltens Sp. z o.o. shall contact the Customer to inform about the delay and confirm further willingness to complete the order. Each time the deadline for receiving a parcel is the time of completing the order plus the delivery time. In case of payment by bank transfer, the above deadline is additionally extended by the time of transfer to the bank account indicated by Oltens Sp. z o.o., and in case of payment by card, by the time of payment authorisation.
16. The time and conditions for the warranty of Oltens products can be found on the Oltens website under "Guarantee". Detailed terms and conditions of the guarantee are specified in the warranty form issued by the guarantor. The guarantee for the sold consumer goods does not exclude, limit or suspend the rights of the buyer arising from the warranty for defects of goods.
17. Oltens Sp. z o.o. shall be liable for product defects on the basis of applicable legal provisions. In the case of sales that are not consumer sales, the warranty provisions of the Civil Code shall be excluded. A complaint may be submitted in an electronic form, at reklamacje@oltens.com, using the contact form available on the website in the "Complaints and Returns" section, or in writing to the address of Oltens Sp. z o.o. given in the upper part of the Terms and Conditions. A correctly submitted complaint should include at least:
  • name, surname, address, e-mail address of the Customer,
  • the date of conclusion of the order constituting the basis for the complaint,
  • order number,
  • invoice number,
  • the subject of the complaint, with an indication of the Customer's request,
  • all circumstances justifying the complaint,
18. If the data or information provided in the complaint need to be supplemented, before the complaint is considered, Oltens Sp. z o.o. shall request the complainant to supplement it within the scope indicated.
19. Oltens Sp. z o.o. shall consider the complaint within 14 days from the date of its receipt in the correct form.
20. The response to the complaint is sent to the e-mail address from which the order was placed. In justified cases, Oltens Sp. z o.o. may send a reply to another e-mail address indicated by the complainant or to traditional mail address.
21. In case of the Customer's willingness to use their rights under the guarantee provided by the manufacturer of the goods, Oltens Sp. z o.o. shall enable him or her to complete and submit the "Complaint Form" available at oltens.com in the "Complaints and returns" section. Information on the manner and procedure of guarantee consideration, Oltens Sp. z o.o. shall make available to the Customer in correspondence which shall constitute an answer to the previously submitted complaint form. Oltens Sp. z o.o. shall respond to the Customer's claims within 5 working days from the moment of reporting the product's non-compliance with the contract.
22. If the delivered product has defects, the Customer shall be entitled to demand a price reduction or withdrawal from the contract, unless Oltens Sp. z o.o. immediately and without undue inconvenience to the Customer replaces the defective product with a defect-free one or removes the defect. This limitation does not apply if the product has already been replaced or repaired by Oltens Sp. z o.o. or Oltens Sp. z o.o. has not replaced the product with a defect-free one, nor has it remedied the defect.
23. If the item sold has a defect, the Customer may demand that the item be replaced with a defect-free item or that the defect be removed. Oltens Sp. z o.o. shall be obliged to replace the defective item with a defect-free item or remove the defect within a reasonable time without undue inconvenience to the Customer. Oltens Sp. z o.o. may refuse to satisfy the Customer's request if it is impossible to bring the defective item into conformity with the contract in the manner chosen by the Customer or it would require excessive costs in comparison with the second possible way of bringing it into conformity with the contract.
24. In each of the above cases, where the execution of the Customer's claims involves the delivery of a new or repaired product, all delivery costs shall be borne by Oltens Sp. z o.o. In order to send back the purchased product, the Customer should write in the consignment note, in the field "declared value" (or equivalent), the purchase price of the returned product. This amount constitutes a declaration of insurance value.
25. In accordance with the applicable legal provisions, within 14 days of receipt of the ordered product, the consumer has the right to withdraw from the contract without giving any reason and without incurring any costs (except for the costs specified in Article 33, Article 34(2) and Article 35 of the Act of 30 May 2014 on Consumer Rights, Dz. U. (Polish Journal of Law) of 2014, item 827; detailed information on the costs in question has also been indicated in Annex no. 1 to the Terms and Conditions - in particular the consumer shall be obliged to bear the direct costs of returning the goods), provided that services and goods the purchase of which cannot be waived in accordance with the applicable legal provisions are not subject to return. The rules for withdrawing from the contract and a template withdrawal form, which the Customer may use, as well as cases in which the right to withdraw from the contract is not granted, are specified in the instruction constituting Annex no. 1 to the Terms and Conditions and Annex no. 2 to the Terms and Conditions (the Withdrawal form). A template withdrawal form is also included in Annex no. 2 to the Act on Consumer Rights of 30 May 2014 (Dz. U. of 2014, item 827).
26. Oltens Sp. z o.o. issues invoices in electronic form in PDF format. The customer receives an electronic invoice to the e-mail address provided when placing an order. The customer may at any time express their wish to receive an invoice in paper form by contacting sklep@oltens.com and providing the order number to which the invoice relates.
27. The information on the websites of Oltens Sp. z o.o. shall not constitute an offer within the meaning of the Civil Code. When placing an order using the mechanisms available on the oltens.com website, the customer makes an offer to buy a specific product under the conditions specified in the product description.
28. The personal data provided by the Customers shall be collected and processed by Oltens Sp. z o.o. in accordance with applicable laws, in particular the General Regulation on Personal Data Protection (OJ of the EU L 119, 4.05.2016, p. 1) and in accordance with the principles set out in the Privacy Policy, which constitutes  Annex 3  to the Terms and Conditions.
29. Oltens Sp. z o.o. may amend the Terms and Conditions and launch a new version of services provided under oltens.com. The amendment shall become effective on the date indicated by Oltens Sp. z o.o., which may not be shorter than 7 days from the date of making the amended Terms and Conditions available at oltens.com, provided that orders commenced before the amendments come into force shall be carried out on the same basis as before.
30. Polish law shall apply to matters not regulated.
31. All disputes related to the services provided by Oltens Sp. z o.o. under oltens.com shall be settled by common courts. A customer who is a consumer has the opportunity to take advantage of the out-of-court method of complaint handling and pursuing claims before the Permanent Consumer Arbitration Court at the Regional Inspector of Trade Inspection in Poznań. 32. Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (the Regulation on ODR in consumer disputes), we hereby provide an electronic link to the ODR platform: http://ec.europa.eu/consumers/odr/. The ODR platform is, inter alia, a source of information on the out-of-court resolution of disputes between consumers and traders arising from online sales or service contracts.
